  • Mayor Mark Lovshin of Hamilton Township potentially illegally fired the Director of Public Works and infrastructure on March 31, 2015.
  • The Mayor did this without any by-law from Council therefore, it was (and still is) a potentially illegal problem that Council is involved in.
  • This meant that there was no designated staff in charge of the water service for some time following the Mayor’s actions. The supervisor who is currently responsible for the water systems right now (Mr. Paul Heffernan) is not licensed to do it.
  • These actions have our Council in a precarious position. If anything were to happen to any citizen of Hamilton Township due to faulty water systems, it could be directly linked to the fact that there is no qualified individual supervising the system. The Mayor and/or Council could very well be held personally responsible and liable.
  • If any member of Council can be proved to have performed an action which he/she did not have the legal power to perform….and if that action causes harm to someone, then the Municipality is not responsible for that councillor’s actions. If the Councillor is sued due to his/her actions, we believe the municipality does not have to provide insurance or legal counsel for said Councillor(s). A Councillor who is deemed guilty of this action is responsible to pay for their own legal counsel as well as all costs of any lawsuit which they may be involved in.
  • There have been three boil water advisories in Hamilton Township since March 31, 2015. Why would Council let Mr. Thompson go without having a qualified person ready to replace him immediately? 
  • After being put in this precarious position, the township put out a tender for someone to “Operate, maintain, and provide other services for Water Supply and Distribution Systems.”

By going to outside contractors for this service our township will:

  1. Lose the qualified staff we already have.
  2. Lose the ability to go back (if in a few years the contractor’s prices skyrocket).  Outsourcing may start out with initially low costs but once locked in has the potential to become very expensive.
  3. Lose our autonomy – is this the first step to Annexation and/or Amalgamation?  We have concerns that Cobourg will win the bid.  Their staff are considered very competent, but do we want to depend on Cobourg to provide our water?
  4. Would not a better option be…. To contract out only the supervisory position and keep all our township staff   qualified and working under the contracted supervisor?
  5. Council will make a decision soon.  We need to get the information out to all citizens of Hamilton Township on the water systems.
